Terms of Service

Welcome to Peak Performance Data ("we", "us", or "our"). By creating an account or using our web application (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. If you are under 16, you may use the Service only with the consent of a parent or legal guardian. By registering, you confirm that you meet this requirement.

2. Your Account

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must provide accurate and complete information when creating your account.
  • You may update your profile information at any time from Settings.
  • You can delete your account at any time from Settings. This will permanently remove your data.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to access another user's data without authorization
  • Upload malicious code or attempt to disrupt the Service
  • Use automated tools (bots, scrapers) to extract data without our permission
  • Share your account credentials with others

4. Your Content

You retain ownership of the data you submit to the Service (match logs, training notes, wearable data, etc.). We process your data solely to provide and improve the Service as described in our Privacy Policy.

5. AI Features

The Service includes AI-powered features (AI Coach, insights, analytics). These features process your data to generate suggestions and analysis. AI-generated content may not always be accurate. You are responsible for evaluating any AI output before acting on it.

6. Video Processing

If you upload match videos for analysis, processing may take 24-72 hours. We are not liable for delays in video processing or for the accuracy of automated shot detection. Uploaded videos are processed on our servers and may be stored for re-analysis.

7. Subscription and Pricing

Some features require a paid subscription. Pricing and feature availability are displayed within the Service. We may change pricing with reasonable advance notice. Subscriptions can be cancelled at any time from Settings or via the Stripe customer portal.

7.1 Auto-Renewal

Paid subscriptions automatically renew at the end of each billing cycle (monthly or annually) until you cancel. You will be charged the then-current subscription fee using the payment method on file. You may cancel at any time to stop future renewals; cancellation does not refund the current billing period but prevents the next renewal.

7.2 Free Trial

If we offer a free trial, you will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. You will receive an email reminder before the trial expires.

7.3 Refunds

Subscription fees are non-refundable except where required by applicable law. If you believe you have been charged in error, please contact us within 30 days of the charge for review. Annual subscriptions may be eligible for a prorated refund within 14 days of purchase, at our discretion.

7.4 Payment Processing

Payments are processed by Stripe, our third-party payment processor. Stripe handles all payment card information securely; we do not store your full card details. By subscribing, you authorize Stripe to charge your payment method for the subscription fees.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or changes that temporarily affect availability. We are not liable for downtime or data loss caused by events beyond our control.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Termination

You may terminate your account at any time. We may suspend or terminate your access if you violate these Terms or if we determine that your usage harms the Service or other users.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice within the Service.

12. California Consumer Privacy Act (CCPA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA):

  • Right to Know: You may request information about the personal data we collect, use, or disclose about you.
  • Right to Delete: You may request deletion of your personal data, subject to certain exceptions.
  • Right to Opt-Out of Sale: We do not sell your personal data to third parties. You may exercise your right to opt-out by contacting us at the email below.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.

13. Children's Privacy (COPPA)

The Service is not directed to children under 16. We do not knowingly collect personal information from children under 16 without verified parental consent. If a parent or guardian believes we have collected information from a child under 16 without consent, they may request deletion by contacting us atdanielsilva@peakperformancedata.app. Parents may create managed accounts for their children (ages 16-18) and have the right to access, modify, or delete their child's data at any time.

14. Dispute Resolution and Governing Law

These Terms are governed by the laws of Portugal and the European Union. Any disputes arising from or relating to these Terms or the Service shall be resolved amicably through good-faith negotiations. If a resolution cannot be reached within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the courts of Lisbon, Portugal.

15. Indemnification

You agree to indemnify and hold harmless Peak Performance Data and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or your misuse of the Service.
